ACYM provides website features and other products and services to you when you visit www.AntiguaCharterYachtMeeting.com & www.AntiguaYachtShow.com, use their Services or products, use ACYM applications for mobile, if available, or use software provided by ACYM in connection with any of the foregoing (collectively, "The Services"). ACYM provides The Services subject to the terms and conditions listed below. By using ACYM Website, you unreservedly agree to and accept these conditions and stipulations. Please read them carefully.

We offer a range of Services, including the registration of Brokers, Vendors, Yachts and sale of Day Passes and additional terms may apply to such services. When you use those Services you also will be subject to the guidelines, terms and agreements applicable to that ACYM Service ("Service Terms & Conditions") in addition to those listed below.

Our website may include third-party advertising and links to other Web sites and other Internet sources. ACYM does not control these websites and these external sources and cannot be held responsible for making these websites and external sources available. ACYM takes no responsibility for the contents, advertising, products, services or any other material available on or from these websites or external sources. Furthermore, ACYM cannot be held responsible or liable for any recognized or alleged damages or losses following on from or related to the use of or access to - or the fact of having trusted - the contents, goods or services available on such websites or external sources.

Hypertext links to the ACYM website may not be created without ACYM’s written prior permission which may be revoked at any time. If this situation arises, ACYM declines all responsibility for the contents of sites linked to the website.

When you use ACYM website, or send e-mails, text messages, and other communications from your desktop or mobile device to us, you are communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this site or through other Services, and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

All content included in or made available through ACYM, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is exclusively the property of ACYM or its content suppliers and protected by Antigua & Barbuda and international copyright laws. The compilation of all content included in or made available through any ACYM Service is the exclusive property of ACYM the only body authorized to use the related rights of intellectual ownership and rights of personality and are protected by Antigua & Barbuda and international copyright laws.

The sale, advertising, promotion, and more generally use or reproduction of any elements of the website requires prior written permission from ACYM. If this clause is violated ACYM can undertake legal action with a view to bring an end to these infringement rights.

In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through any ACYM are trademarks or trade dress of ACYM in the Antigua & Barbuda and other countries. ACYM’s trademarks and trade dress may not be used in connection with any product or service that is not ACYM’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits ACYM. All other trademarks not owned by ACYM that appear in ACYM website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by ACYM.

Subject to your compliance with these Conditions of Use and your payment of any applicable fees, ACYM or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of The Services. This license does not include any resale or commercial use of any of The Services or contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any ACYM service or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Conditions of Use or any Service Terms are reserved and retained by ACYM or its licensors, suppliers, publishers, rights holders, or other content providers. No ACYM service, nor any part of any The Services, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of ACYM. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of ACYM without express written consent. You may not use any meta tags or any other "hidden text" utilizing ACYM's name or trademarks without the express written consent of ACYM. You may not misuse The Services. You may use The Services only as permitted by law. The licenses granted by ACYM terminate if you do not comply with these Conditions of Use or any Service Terms.

The National Parks (Trading) Regulations 2014 requires persons doing business in the National Parks of Antigua & Barbuda to hold a licence issued by the National Parks Authority (“the Authority”). The Regulations also prohibit individuals or partnerships who are non citizens of Antigua & Barbuda, or who are not in possession of a valid work permit issued under the Antigua & Barbuda Labour Code, or a company which is not incorporated under the Laws of Antigua & Barbuda, or registered as an external company, and in possession of a registration number issued by the Commissioner of Inland Revenue from being granted a licence. Offenders can face a number of fines and penalties including imprisonment of up to 6 months if caught in violation of the Regulations. This is applicable to the English Harbour and Falmouth area (“the Park”) where the ACYS is held. ACYM has the sole and exclusive rights as granted by the Authority to organize, plan and host the ACYS and all events held during the Show in the Parks are required to be approved by and held under the auspices of the ACYM.

ACYM reserves the right to correct the website content at any time without prior notice. However, we cannot guarantee the accuracy, precision or exhaustiveness of information made available on the website. Despite the care taken when creating and regularly updating the site, some errors may crop up in the forms and/or documents contained therein. The Editor's responsibility may not be engaged for such errors.

ACYM does not accept any responsibility for:

• any downtime of ACYM website;
• virsues;
• any inaccuracy or omission pertaining to information available on the website;
• any damages resulting from the fraudulent intrusion by a third party leading to changes in information made available on the website; and
• more generally any damages, direct or indirect and of any nature, caused by or originating from use of the website.

UNLESS OTHERWISE SPECIFIED IN WRITING, ACYM MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICES, OR THE INFORMATION, CONTENT, MATERIALS, (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICES, UNLESS OTHERWISE SPECIFIED IN WRITING. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, ACYM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ACYM DOES NOT WARRANT THAT THE SERVICES, INFORMATION, CONTENT, MATERIALS, (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICES, ACYM’S SERVERS OR ELECTRONIC COMMUNICATIONS SENT FROM ACYM ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ACYM WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY ACYM SERVICE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH ANY ACYM SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.

Any dispute or claim relating in any way to your use of any ACYM Service, or to any products or services sold or distributed by ACYM or through the website will be resolved by and in accordance with the Arbitration Act Cap 33 of the Revised Laws of Antigua and Barbuda.

By using any ACYM Services, you agree that the laws of Antigua & Barbuda, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and ACYM.

Broker Service Terms and Conditions

All Charter Brokers linked to the associations and independent brokers (with relevant required information) listed below are invited to register for the Antigua Charter Yacht Show (ACYS) and will be accepted upon approval by the ACYM Panel. ACYM reserves the right to review all applications and to accept and or deny any.

List of Associations and Independent brokers

• American Yacht Charter Association (AYCA)
• Mediterranean Yacht Brokers Association (MYBA)
• International Yacht Brokers Association (IYBA)
• Charter Yacht Brokers Association (CYBA)

For each New Charter Broker Company / (New to the ACYM) the following will be required:

1. Proof of employment as a Charter Broker for at least one year. (To be uploaded on the website).
2. Proof that the Company has been trading for at least one year. (To be uploaded on the website).
3. Written confirmation from two Charter Managers (outside the broker’s company) with whom the applying Broker has booked a charter on a yacht within the past year (This is to be done online via the Broker & Referees section in the Broker Registration Form).
4. Official documentation such as Company statutes showing the majority of the business activity is in yacht charter brokerage.

Charter Brokers who have been registered in previous ACYS, are required to resubmit credentials every three years from first registration in order to update their status.

No passes will be authorized unless the above criteria is fulfilled.

Charter Brokers who are not in the above listed categories and need to provide references and paperwork for their registration cannot register at the Reception Desk. Only New Brokers who have pre-registered and completed the above criteria will be granted access to the show.

The Broker registration fee is USD$180.00, June 1 - August 31, 2023 and USD$200.00 thereafter (plus credit card /wire transfer fees and 15% Antigua and Barbuda Sales Tax (ABST)).

Fees are non-refundable after November 1st. Broker registration may be transferred free of charge from one Broker to another within the same company.

Any registrations, changes and/or modifications received after November 15th or still unpaid on that end date will not appear in the list of attending brokers in the Show Catalogue.

Vendors Service Terms & Conditions

Attendance at the Antigua Charter Yacht Meeting (ACYM) is subject to the Antigua Charter Yacht Meeting Panel (“the Panel”) final approval. Vendors should only be representing the company under which they registered and which was accepted by the ACYS Organizers. It is not permitted to present more than one company at the ACYS. A business card will be required when picking up ACYS badges.

The Vendor registration fee is USD$405.00, June 1 - August 31, 2023 and USD$450.00 thereafter (plus credit card / wire transfer fees and 15% ABST).

Vendors can only register two (2) show participants from each company. There is a limit to the number of Marine Vendors within the absolute discretion of ACYM. It is advisable that any marine vendor should register and receive confirmation of their participation at the ACYS prior to making their travel arrangements. 

Registrations are only valid when completed in full and cleared funds have been received.

All events to be organized during or around the ACYS should be submitted to the ACYM Panel for pre-approval or will not be permitted to run.

A brief description of the activity of the exhibiting company – maximum 600 characters including spaces – will be required as part of the registration. Upon acceptance of the attendance, the company description will be displayed on the ACYS website and included in the catalogue free of charge.

Yachts Service Terms & Conditions

All Yachts and Brokers must commit to attending the full 5 viewing days during the period of the Show. Please note that yachts cannot leave before the end of the Show.

Yacht Registration is not transferable from one yacht to the next.

Agreements must be in place for the use of the yacht images in our catalogue and for display on our website signaling the yacht’s attendance at the ACYS. Any yacht or crew deemed to be causing a nuisance amongst other yachts and exhibitors or who fail to adhere to the rules and conditions of the ACYM would be asked to leave the Show. Yacht fees paid are non refundable on expulsion.

1. Yachts cancelling prior to October 15th will receive 100% refund (LESS BANK CHARGES).
2. Yachts cancelling after October 15 but up to October 31st will get 50% credit for the next year show. The 50% credit of the yacht applicable is valid for only 1 year.
3. There will be NO REFUND for Yachts cancelling on & after November 1st.

The Yacht For Sale registration fee is USD$900.00, June 1 - August 31, 2024 and USD$1000.00 thereafter (plus credit card / wire transfer fees and 15% ABST).

Registrations are only valid when completed in full and cleared funds have been received.
